Terms and Conditions

redbullbcone.com is a webpage operated by Red Bull GmbH, Am Brunnen 1, 5330 Fuschl am See, Austria (hereinafter referred to as “Red Bull”). By using redbullbcone.com and/or registering as a member of redbullbcone.com you agree to be bound by the following General Terms and Conditions. Red Bull may amend the General Terms and Conditions at any time in its sole discretion and such amendment shall be effective upon posting them on redbullbcone.com.

1. Personal Data

The User expressly agrees that personal data of the User, which have been disclosed for the registering process, are automatically stored and used by Red Bull, affiliated companies and contractual partners in particular for marketing purposes.

2. Membership

By registering on redbullbcone.com the User can apply for a membership in the redbullbcone.com-community. This membership gives the User the possibility to create a personal profile and to share videos and pictures with other members of the community. Red Bull may in its sole discretion and at any time terminate the membership with immediate effect.

3. Content

The User has the possibility to submit videos and pictures (hereinafter referred to as “Content”) to rebullbcone.com. By submitting the Content to Red Bull the User grants Red Bull a non-exclusive, worldwide, irrevocable and unlimited license to use the Content as follows:

1. usage in any media, including without limitation commercial and/or non-commercial broadcasting, immaterial display, in whole and in part, exploitation on audiovisual media, DVD, by radio, television and cable networks, on the Internet and in any other media currently known and any other potential present or future use (whether or not already known on the date hereof), for example also on the Internet or in other new media;
2. editing (in whole or in part), duplication, distribution (physical and non-physical distribution, including leasing and lending rights), adaptation, transmission – especially by means of satellites – and non physical reproduction of the Film;
3. usage in the framework of the online video archive “Red Bull Digital Video Archive”;
4. any possible below-the-line-marketing purposes, including but not limited to the use in connection with folders, flyers, leaflets, posters etc.;
5. any possible above-the-line-marketing usage, including but not limited to classical advertising.

The territory for the license shall be worldwide. The term of the license shall be unlimited.

Red Bull may transfer these rights in whole or in part to third parties, grant sublicenses and rights and/or permits to exercise the rights, and it may exercise these rights itself or through third parties. Furthermore Red Bull is entitled to exercise the rights designated in § 20 (designation of the copyright owner) and § 21 Section 1 (copyright protection of the work) UrhG (Austrian Copyright Act). Therefore the name of Planet Watch needs not to be mentioned. Red Bull is not obliged to exercise these rights.

The User warrants that he is entitled to grant Red Bull the rights specified herein in respect of the Content and that it has secured all consents (including those of all artists, musicians and others whose performances or materials are reproduced in the content) necessary for the exercise by Red Bull of said rights and that the broadcasting of the Content will not infringe the rights of any third party.

The User shall be solely liable for the Content submitted by the User to Red Bull and shall indemnify and hold harmless Red Bull and affiliated companies for any and all damages arising Red Bull and affiliated companies out of or in connection with the Content submitted by the User.

Red Bull may at its sole discretion delete any Content at any time.

4. Liability

Red Bull shall only be liable in cases of gross negligent or intentional behaviour of Red Bull. This restriction does not apply for injury to life, body and health.

5. Legislation

This agreement and any and all disputes arising out of or in connection with the agreement are governed by Austrian law under exclusion of the UN purchase right. The exclusive place of jurisdiction shall be the court competent for Vienna – Inner City, Austria.
